Terms of Service

By accessing or using Chunky AI ("Chunky," the "Service"), operated by AvatarOS, Inc. ("AvatarOS," "we," "us," or "our") at getchunky.ai, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Chunky is a file collaboration and AI analysis platform. Users can upload large files (video, audio, images, and documents), receive AI-powered analysis and summaries, collaborate with others through shared links, and communicate via AI-assisted chat. The Service also allows users to share files and collaboration links via email and SMS text message.

To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information when creating your account and to update it as needed.

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

You retain ownership of all files, data, and content you upload to the Service ("User Content"). By uploading User Content, you grant AvatarOS a limited, non-exclusive license to store, process, and analyze your content solely to provide and improve the Service.

You are solely responsible for your User Content and represent that you have all necessary rights to upload and share it. You agree not to upload content that infringes on any third party's intellectual property or other rights, contains malware or harmful code, is unlawful, defamatory, or otherwise objectionable, or violates any applicable laws or regulations.

The Service allows you to share files and collaboration sessions with others via links, email, and SMS. When you share content, you are responsible for ensuring that you have the right to share it and that you share it only with intended recipients.

Collaboration links provide access to anyone who has the link. Treat collaboration links as you would any sensitive URL. You can revoke collaboration links at any time through the platform.

When you use the Service to send a file or collaboration link via SMS, the recipient will receive a single transactional text message. By providing a phone number and requesting an SMS be sent, you represent that you have the recipient's consent to receive the message or that you have a reasonable basis for sending it.

We do not send marketing or promotional text messages. Recipients may reply STOP to any message to opt out. Message and data rates may apply.

The Service uses artificial intelligence to analyze files, generate summaries and transcripts, and power chat functionality. AI-generated content is provided for informational purposes and may not always be accurate or complete. You should not rely solely on AI-generated content for critical decisions.

Your files may be processed by third-party AI providers (such as OpenAI and Anthropic) to deliver these features. By using the Service, you acknowledge and consent to this processing.

You agree not to:

Use the Service for any illegal purpose or in violation of any applicable law; upload or transmit viruses, malware, or other harmful content; attempt to gain unauthorized access to the Service or its systems; interfere with or disrupt the Service or servers; use the Service to send unsolicited or unauthorized messages (spam); reverse engineer, decompile, or disassemble any part of the Service; or use the Service in a manner that could damage, disable, or impair it.

The Service, including its design, features, code, and branding, is owned by AvatarOS and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or brand features without prior written consent.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. AvatarOS does not warrant that the Service will be uninterrupted, error-free, or secure.

To the maximum extent permitted by law, AvatarOS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of data, loss of profits, or business interruption.

You agree to indemnify and hold harmless AvatarOS, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your User Content, or your violation of these Terms.

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will remain in effect.

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
